Platform Governance & Regulatory Disclosure

This agreement incorporates Section 230 of the federal Communications Decency Act (47 U.S.C. § 230), the Digital Millennium Copyright Act (17 U.S.C. § 512), the federal Fair Housing Act (FHA), and established marketplace commerce standards.

1. Nature of Service & Legal Classification (Neutral Interactive Computer Service)

1.1 AI168 (ai168.io, the 'Platform') is owned and operated by AI168 Technology Inc, a corporation organized under the laws of Delaware. Compliance inquiries: support@ai168.io.
1.2 Neutral Technology Status: Pursuant to Section 230 of Title 47 of the United States Code (47 U.S.C. § 230), AI168 operates as an Interactive Computer Service Provider. The Platform provides digital hosting tools and is not the publisher or speaker of any third-party user-generated content (UGC).
1.3 Zero Financial Intermediation: The Platform provides information display and communication tools only. AI168 is not a party to any transaction, does not collect or hold funds in escrow, and does not operate as a Money Transmitter. Buyers and sellers transact peer-to-peer (e.g., cash, Zelle) at their own direction.
1.4 Informational AI Tools: Smart text formatting and AI search features are provided solely for convenience and do not constitute legal, tax, real estate, or investment advice.

2. Micro Shops & Commercial Marketplace Policies

2.1 Independent Merchant Liability: Sellers listing merchandise or services operate as independent commercial parties and bear sole and exclusive legal liability for item accuracy, legality, safety, and order fulfillment.
2.2 Prohibited Items & Services: The listing or sale of the following is strictly prohibited:
• Firearms, ammunition, tactical weapons, and hazardous explosives;
• Tobacco, electronic cigarettes, nicotine derivatives, and cannabis products;
• Prescription medications, unapproved medical devices, and controlled substances;
• Counterfeit goods, unauthorized replicas, and pirated software or media;
• Endangered wildlife species, human remains, or bodily fluids;
• Pyramid schemes, fake job assignments, unauthorized currency exchange, and predatory lending.
2.3 Cottage Food & Handmade Prepared Goods: Sellers offering homemade foods or confections must comply with applicable state and municipal Cottage Food Laws and Health Department sanitation standards.

3. Offline In-Person Meetings & Complete Assumption of Risk

3.1 Nature of Local Classifieds: Local classified services often involve physical property walkthroughs, job trials, or in-person merchandise exchanges.
3.2 Safety Rules: Never wire deposits or share personal financial credentials prior to meeting and inspecting items in person. Always meet during daylight hours in busy, well-lit public venues (e.g., transit station entrances, supermarket plazas). Review our Safety Guide at ai168.io/safety.
3.3 Full Assumption of Risk: Users knowingly assume all risks associated with offline meetings and transactions. AI168 disclaims all direct, indirect, incidental, or consequential damages resulting from offline conduct between users.

4. User-Generated Content (UGC), DMCA Safe Harbor & Anti-CSAM Strict Policy

4.1 Intellectual Property Warranty: Users warrant and represent that they own or hold necessary licenses for all photos, videos, and texts uploaded to the Platform.
4.2 DMCA Notice & Takedown: AI168 strictly complies with 17 U.S.C. § 512 (see ai168.io/dmca). Accounts receiving two or more verified infringement notices without successful counter-notice will be permanently terminated as repeat infringers.
4.3 Zero Tolerance for Child Sexual Exploitation (CSAM): In accordance with 18 U.S.C. § 2258A, any suspected CSAM will be immediately preserved and reported to the National Center for Missing & Exploited Children (NCMEC CyberTipline) and federal law enforcement.
4.4 Non-Consensual Imagery: Pursuant to the Take It Down Act, non-consensual intimate imagery will be permanently expunged within 48 hours of verified notification.
4.5 Indemnification: Users agree to indemnify, defend, and hold harmless AI168 Technology Inc and its affiliates from and against any third-party claims, liabilities, or legal expenses resulting from content they submit.

5. Anti-Discrimination & Fair Housing Act (FHA) Compliance

5.1 Pursuant to the federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and New York State & City Human Rights Laws, housing and employment listings may not state discriminatory preferences based on race, color, national origin, religion, sex, familial status, disability, or source of income (including Section 8 vouchers).
5.2 Entire-unit rentals may not include nationality or ethnic restrictions. Gender preferences are lawful only in shared single-room living arrangements where the owner or co-tenant shares living facilities.
5.3 Employment listings must meet or exceed statutory minimum wage requirements and may not charge recruitment or application fees.

6. 168AI Coins & Premium Paid Subscriptions

6.1 168AI Coins are promotional platform reward points for visibility features (bumps, highlights, featured pins). Coins have zero monetary or cash value and cannot be exchanged, redeemed, or refunded for legal currency.
6.2 Confirmed community fraud reports earn 10 168AI Coins upon verification. Malicious or abusive reporting may result in account restrictions.
6.3 Refund Terms: Unused VIP memberships or unspent coin packages requested within 7 days of purchase are eligible for refund. Duplicate transaction errors are refunded in full unconditionally (see ai168.io/refund).

7. As-Is Disclaimers & Limitation of Liability

7.1 The Platform and all features are provided on an 'AS-IS' and 'AS-AVAILABLE' basis without warranties of any kind.
7.2 Good Samaritan Immunity: Content moderation and fraud prevention actions are taken in good faith pursuant to 47 U.S.C. § 230(c)(2) and do not create liability for third-party content.
7.3 In no event shall AI168 be liable for indirect, punitive, or consequential damages resulting from platform downtime, cyber incidents, or user misconduct.

8. Amendments & Governing Law

8.1 The Platform reserves the right to amend these Terms at any time by posting notice on the website. Continued use constitutes acceptance of revised terms.
8.2 These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
